Services

  • The Services comprise allowing users to search for sports competition results.
  • The Services are provided free of charge and solely for non-commercial purposes.
  • The Provider is entitled to reserve the provision of a certain type of Services to Registered Users only.
  • The User acknowledges and agrees that Services may be provided through/by third parties or in cooperation with third parties.
  • The Registered User is entitled to use the Services without further restrictions within the range of Services provided.
  • The Unregistered User may use the Services to a limited extent; particularly the Unregistered User may only search for sports competition results.

1. Acceptance of Terms

By accessing or using Medals.live ("Site"), you agree to comply with and be bound by the following terms and conditions (the "Agreement"), which we may change at any time by posting notice on the Site. PLEASE READ THIS AGREEMENT CAREFULLY, AND PLEASE CHECK THESE TERMS AND CONDITIONS PERIODICALLY FOR CHANGES. If you do not agree to these terms and conditions, please do not use the Site. Use of our Site is limited to individuals who can form legally binding contracts under applicable law, and without limiting the foregoing, our services are not available to minors. Medals.live has agreed to provide certain of its content and other proprietary material to its partners (the "Partners") on their websites (the "Partner Sites"). All the text, images, marks, logos, compilations (meaning the collection, arrangement and assembly of information), and other content of the Site, all of the foregoing provided by Medals.live to the Partner Sites, and any of the foregoing sent to you by e-mail or other means (collectively, the "Site Content") are proprietary to us or to third parties. Medals.live authorizes you to view, download, and print the Site Content subject to the following conditions: (i) you may only download and print the Site Content in limited quantities as required to evaluate whether the goods and services of Medals.live are appropriate for your use; (ii) you many not use any automated process or software program to view, download, print or otherwise use Site Content; (iii) you may not use any of the Site Content for the purpose of soliciting, for any service or product, companies that have information included in the Site Content; (iv) you may not modify the Site Content; (v) any displays or print outs of the Site Content must be marked "© Medals.live, Inc., 2024. All rights reserved."; and (vi) you may not remove any copyright, trademark, or other proprietary notices that have been placed in the Site Content. Except as expressly permitted above, copying; modifying; storing for any period of time, for any use other than specified in (i) above; reproduction; redistribution; republication; uploading; posting; transmitting; distributing or otherwise exploiting in any way the Site Content, or any portion of the Site Content, is strictly prohibited without the prior written permission of Medals.live. All software used on the Site is proprietary to us or to third parties, and except as may be required to exercise the foregoing license grant, any use, redistribution, sale, de-compilation, reverse engineering, disassembly, translation or other reduction of such software to human-readable form is prohibited.

The marks Medals Live, and any other marks used to identify services, products or sections of the Site are proprietary to us, and they may not be used in connection with any service or products other than those provided by Medals.live, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Medals.live.

You agree, and represent and warrant, that your use or other exploitation of the Site and the Site Content, or any portion thereof, will be consistent with the foregoing license and restrictions and will neither infringe nor violate the rights of any other party or breach any contract or legal duty to any other parties. In addition, you agree that you will comply with all applicable laws, regulations and ordinances relating to the Site, the Site Content or your use of them, and you will be solely responsible for your own individual violations of any of them.

Medals.live, Inc. does not allow use by or accept membership registrations from users who are under 13 years of age. By using the Site or registering with Medals.live. you represent that you are at least 13 years old.

3.2. Permitted Use, Limitations on Use

The Site provides access to certain sports competition results. You may access and view any sports competition results on your web browser for your individual use, maintaining all copyright and other notices.

3.3. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any local, state, national, or international law.
  • Upload, post, or otherwise transmit any content that infringes the rights of any party or that is unlawful, offensive, abusive, defamatory, or harmful.
  • Use the Site to distribute spam or other unwanted communications.

4. Intellectual Property

4.1. Ownership

The Site and its original content, features, and functionality are owned by Medals.live and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

If you submit content to the Site, you grant Medals.live a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, and distribute such content in any form, medium, or technology now known or later developed.

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

The Site and Site Content are provided in "AS IS" condition, and Medals.live EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING: (i) ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY AND ALL WARRANTIES ARISING FROM COURSE OF DEALING AND USAGE OF TRADE; (ii) THAT THE SITE AND THE SITE CONTENT WILL MEET YOUR REQUIREMENTS, WILL ALWAYS BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE OR OPERATE WITHOUT ERROR, (iii) AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE OPERATION, USE OR OTHER EXPLOITATION OF THE SITE OR THE SITE CONTENT, (iv) AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED FROM THE SITE OR THE SITE CONTENT AND (v) AS TO ANY PARTNER SITE OR ITS CONTENTS. No advice or information, whether oral or written, obtained by you from Medals.live or through the Site or Site Content will create any warranty not expressly stated herein. YOU USE THE SITE AND THE SITE CONTENT AT YOUR OWN RISK, AND Medals.live WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATING TO THEIR OPERATION, USE OR OTHER EXPLOITATION. You waive and covenant not to assert any claims or allegations of any nature arising from or relating to the operation, use or other exploitation of the Site or the Site Content, including any allegation or claim that Medals.live has or should indemnify, defend, or hold you harmless from any claim or allegation arising from the operation, use or other exploitation of the Site or the Site Content. UNDER NO CIRCUMSTANCES WILL YOU BE ENTITLED TO RECOVER FROM Medals.live OR ANY OF ITS PARTNERS ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS OR LOSS OF USE), WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE ARISING FROM OR RELATING TO THE SITE OR SITE CONTENT OR YOUR USE THEREOF, EVEN IF Medals.live OR ITS PARTNERS HAVE BEEN INFORMED OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF WARRANTIES OR OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

7.2. Your Indemnity of Medals.live and its Partners; Termination of Use

You agree to indemnify and hold Medals.live and its Partners harmless from all causes of action, claims and allegations (whether threatened or pending), costs, fees, charges, and expenses (including reasonable attorney and professional fees), judgments, damages, losses, and liabilities arising from or relating to the breach or alleged breach of your duties or obligations under this Agreement or your use of the Site or Site Content. For any indemnified matter, Medals.live and its Partners will have full control of the response thereto and the defense thereof, including, without limitation, any agreement relating to the settlement thereof, and you will cooperate with Medals.live and its Partners in such matter. Medals.live and any of its Partners may, at their option, terminate any person or entity's access to any or all of the Site upon any breach of the terms and conditions of this Agreement.

7.3. Although the Sites Discuss Consumer Products and Other Issues, the Site Itself Do Not Provide Specific Recommendations or Advice

The Site is designed to provide useful publications and a forum for those interested in user sports competition results. The Site does not provide specific recommendations for any particular situation or circumstances, even if materials cited on, identified by or obtained as a result of using the Site do so. Such recommendations may only be provided by a qualified professional advisor who is familiar with your particular circumstances and other relevant information. In part because Medals.live is not involved in the purchase or sale of any materials that the Site may discuss, if a dispute arises between you and any seller or purchaser of such materials, you understand that Medals.live has no obligation to become involved, and you hereby release Medals.live from all claims, demands and damages (actual, consequential or otherwise) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising from or relating to any such dispute. These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

10. Miscellaneous

10.1. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

These Terms, along with the Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and Medals.live regarding the Site.

10.3. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Medals.live’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
